Section I. General Provisions

1.1 Who we are

TaurusX is a global programmatic advertising technology provider. We develop and operate various advertising platforms that serve targeted ads, plan campaign and optimize ads, whether by itself or through third party partners.

1.2 This Privacy Policy

This Privacy Policy explains how information, including personal information, may be collected, used, and disclosed by TaurusX in connection with its advertising technology platform and all advertising-related services delivered through it.  with respect to the following instances:

(i) use of this website located at www.taurusx.com (the "Website" or the "Site"), and

(ii) how personal information is collected, used, and processed through our technology (including, but not limited to, its SDK, API and real-time bidding systems) on behalf of the online advertisers, publishers, business partners, and other businesses that use TaurusX advertisement materials and/or inventory or services (hereinafter referred to as “clients”).

1.3 Our Services and Compliance with Law

In delivering our services, we typically process personal information on behalf of our clients as a data processor or independent controller. We do not directly interact with the owners of personal information unless the owner of information is our clients. . Rather we receive personal information from various sources, such as applications partners, data vendors or clients (“Sources”), which may include third party apps, sites and services that you use.  

If you would like to understand how those apps, sites and services collect, use, and share data from your interactions with them, please refer to the privacy policies of the apps, sites, and services you use (TaurusX is not responsible for how those third-party apps, sites and services collect and use data). If you would like to read the information regarding our services and possible use of personal information, please read Section II of this Privacy Policy. If you would like to know about the information collected solely on this Website, please read Section III of this Privacy Policy. If you are our client, please refer to our agreement and then to this Policy (if applicable).

Section II. Information collected from end users or owners of personal data other than our clients

2.1 Information We Collect, Process, or Store

In the course of providing services to our clients we do not collect information that reveals your real-world identity, such as your name, address, phone number, or social security number. We do not collect any sensitive data such as racial or ethnic origin, political opinions, religious or philosophical beliefs, genetic data, biometric data, data concerning health. The information we collect is pseudonymous, generalized, and is not considered to be personal information in the majority of jurisdictions. In some other jurisdictions in which we provide services to our clients, in certain contexts, such information, including Internet Protocol (IP) addresses and other pseudonymous information, like certain unique device identifiers that may identify a particular computer or mobile device (for instance, in European Union)) may be considered to be personal information.

Please take notice, that we may work with third party data platforms or applications that may be directly integrated into our technology or used separately, supplementing our technology by us or our clients. It helps to deliver targeted advertisements using our advertising technology more efficiently or it allows our clients to use multiple interfaces and manage data more efficiently. Finally, our clients may use third-party data in combination with your user information to deliver targeted advertisement materials and/or inventory across multiple devices. To ensure compliance, we contractually require third party partners to warrant that any data provided to our platform is collected in compliance with applicable laws, including obtaining valid legal bases for processing and providing transparent notice to end users.

We are committed to protecting your personal data. We only collect and process the following information when it is necessary and with your explicit consent.

YOU SHOULD REVIEW THE PRIVACY POLICY AND TERMS OF USE FOR ANY SITE OR APPLICATION YOU VISIT OR INSTALL TO LEARN ABOUT WHAT INFORMATION THOSE SITES COLLECT FROM YOU, AND HOW THEY USE AND SHARE SUCH INFORMATION. THE INFORMATION IN THIS PRIVACY POLICY MAY NOT REFLECT WHAT AND HOW OUR CLIENTS OR WE COLLECT ON ANY OTHER INDIVIDUAL SITE.

(a) Device identifiers. Device identifiers are alphanumeric strings that are unique to your device. These include:

iOS devices’ Identifier for Advertising (IDFA) and iOS Identifier for Vendors (IDFV)

Google Advertising ID (GAID), or Android ID for Android devices

Identifier for Advertising on OTT and CTV platforms

International mobile equipment identity (IMEI), in certain jurisdictions as permitted by applicable law

(b) Location information, including:

Geo-location or precise location of your device if you have given the app or site permission to collect your location information

Location information we infer from your device’s IP address, provided that we will not infer location from an IP address to a more precise than city-level of accuracy unless you have given the app or site permission to collect your location information

(c) Network information, including:

Mobile carrier

Network provider or ISP

Network type (e.g., WiFi or cellular)

IP address

IDs of WiFi access points to which your device is connected

Date and time of connection

(d) Information about apps or sites and our Software Development Kit (SDK), including:

App or site name or version

App identifier

SDK version

API key identifier

(e) Other information about/on your device, including:

Device type (e.g., make and model)

Device startup time and update time

Device name

Screen size

Memory and hard drive capacity

Operating system and version (e.g., iOS 14, Android, Windows, Blackberry)

Mobile browser used (e.g., Chrome, Safari, Firefox)

Language settings (including country code) and time zone

App usage

Device sensor signals (Accelerometer, Gyroscope, Proximity sensor, Orientation/Rotation Vector, Audio Controls Integration)

(f) Advertisement information. We collect information about the ad presented on your device, including:

The content type of the ad (the advertiser and category, e.g. games, finance, entertainment, news)

The ad type (e.g. whether the ad is text, image, video or other format based)

Where the ad is being served (e.g. the site, digital media or app on which the ad appears)

Whether you viewed, clicked or otherwise interacted with the ad

Please note that we are dedicated to safeguarding your privacy and will inform you clearly before collecting, using, or sharing your personal data.

2.2 How We Collect User Information

We act on assumption that consumers prefer relevant ads, tailored in accordance with their interests. Therefore, we collect a variety of data using cookies and various other standards (typical for the industry) and unique (if our technology allows so) web technologies to collect information automatically from your device, we may also combine information we collect with other information we derive through analytical techniques and we will use that combined information to provide our services.

2.3 How We Use User Information

The information that we collect about you, both personally identifiable information and non-personally identifiable information, may be used by us, or shared by us as set forth in this Privacy Policy or otherwise with your consent.

We primarily use the user information we collect to enable our clients to find and purchase advertising space, including the following purposes:

(a) Advertising presented through our Service can be based on limited data, which is intended to enable processing activities such as

Selection and delivery of an advertisement based on real-time data (e.g. information about the page content, device information, app type, non-precise geolocation data etc.)

Real time data, as referenced above, may be used for positive or negative targeting.

Control the frequency of advertisements shown.

(b) Create profiles for personalised advertising, which is intended to enable processing activities such as:

Associate data collected, including information about the content and the device, such as: device type and capabilities, user agent, URL, IP address with a new or existing advertisement profile based on user interests or personal aspects of the user.

Establish retargeting criteria.

Establish positive or negative targeting criteria.

(c) Use profiles to select personalised advertising, which is intended to enable processing activities such as:

Select advertisement based on a personalised advertisement profile.

Select an advertisement based on retargeting criteria.

Select an advertisement based on positive or negative targeting criteria tied to a profile.

(d) Measure advertising performance, which is intended to enable processing activities such as:

Measure how brand suitable or safe the content of the digital property where the advertisement was served was.

Measure the percentage of the advertisement that had the opportunity to be seen and for how long.

Measure how many devices engaged with an advertisement, for how long and what was the nature of that engagement (click, tap, hover, scroll etc.).

Determine how many devices an advertisement was served to.

Measure/analysis the characteristics of the device the advertisement was served to.

(e) Understand audiences through statistics or combinations of data from different sources, which is intended to enable processing activities such as:

Provide aggregate reporting to advertisers, publishers or their representatives about the unique reach of online services and/or the audiences of their advertisements, through panel-based and similarly derived insights.

Create market research aggregate reporting.

(f) Develop and improve services, which is intended to enable processing activities such as Service improvement or new Service development.

In particular, our clients use two types of information in order to deliver end users a targeted advertisement material: our client’s information and information that we provide in the course of our services delivery. Those two types of information are usually synchronized and mutually filtered and checked to identify what are the main interests of the user, and what targeted advertisement materials should be sent to him or her based on all the information that we stated as collected in this section. Additionally, we may use the information to facilitate the delivery of advertisements as to provide better service.

2.4 Who We Share User Information With

TaurusX may share information we collect or process in the following circumstances and with the following categories of recipients:

(a) Advertising Demand Partners. We share your information we collect about you with entities that participate in programmatic auctions or deliver advertisements via TaurusX Services, which may include demand-side platforms, advertising networks, or other advertising demand sources. Advertising Demand Partners may use your data to predict which ads or campaigns you will be most likely to engage with and make other inferences about you, among other activities.

(b) Publishers and Supply Partners. We share your information with publishers (the app or site publishers) to help them understand how users interact with their apps and sites and advertisements on their apps and sites

(c) Service Providers. We may share personal information we collect about you with third-party service providers, which may include Measurement & Analytics Partners, Fraud & Security Partners and Cloud Service Partners. They are engaged to support our business, such as providing cloud hosting services, analyzing how our services are used, measuring the effectiveness of ads and detecting fraud.

(d) Regulatory or Legal Requirements. We may disclose information to governmental regulatory authorities as required by law, including for tax or accounting purposes, in response to their requests for such information or to assist in investigations. We may also disclose personal information to third parties in connection with claims, disputes, or litigation, or when otherwise required by law or court order.

(e) Safety and Terms Enforcement. We may disclose information if we determine, in our sole discretion, that its disclosure is necessary to protect the health, safety, or rights of you or any other person, protect against fraud, or enforce our legal rights, including contractual commitments made to us by third parties.

2.5 Business Transfers.

We may disclose personal information as part of an organizational business transaction, such as a merger, acquisition, joint venture, financing, or sale of organizational assets, and may transfer personal information to a third party as one of the business assets in such a transaction. We may also disclose personal information in the event of insolvency, bankruptcy, or receivership.  We will issue a prominent notice via email and/or on our website or other appropriate methods to inform you of any changes in ownership and your rights to your Personal Information, and any choices you may have about your Personal Information.

2.6 How We Store User Information

The information that we collect about you will be stored in accordance with the laws and regulations on the personal privacy data protection of the countries concerned. To the extent not prohibited by local laws and regulations, we may also store the collected information in countries or regions outside the country where our business is located.

Currently, the information we collect may be stored on servers located in Virginia (US), Singapore, Japan and Frankfurt (Germany). According to business conditions, we may use servers in other regions or countries in the future, and we will update this Policy at that time.

We typically retain information for up to thirteen (13) months, unless a longer or shorter period is required by law, necessary to fulfill contractual obligations, or needed to resolve disputes or enforce agreements. After this period, we will delete your information or retain it only in anonymized or aggregated form.

2.7 Opt-Out Options for Targeted Advertising

TaurusX respects your control over personalized advertising experiences. Below are methods to stop receiving targeted advertising that our clients may apply using our technology. Note that technical implementations may vary by device,platform or jurisdiction.

(a) Your Ad Choices Control in the apps

If you consented to targeted advertising within a specific app, withdraw consent directly through that app's privacy settings. Look for options labeled "Advertising Preferences" or similar in the app's settings menu.

You can also opt-out of having your Mobile IDs used for certain types of interest-based mobile advertising (also called “cross-app advertising”), including those performed by TaurusX, by accessing the settings on your IOS or Android mobile device, as follows:

On an IOS device, if you are using iOS 14.5 or above, you can click on "Ask the App Not to Track" in the app's asking pop-up window or manage your "Tracking" settings in [Settings] - [Privacy] . On Android devices, your settings may allow you to “Opt out of Interest-Based Ads.” When you opt out using this setting on a device, TaurusX will not use information collected from that device to infer your interests or serve ads to that device that are targeted based on your inferred interests.

Please be advised that this policy is not intended to serve as your user manual for your device, and you should always contact the manufacturer to obtain updated guidance.

(b) Your Ad Choices Control for the Web

You can opt-out of many of the publishers, platforms and service providers we work with that support onlinetargeted advertising from cookies or similar technologies by visiting the Digital Advertising Alliance’s consumer education and opt-out page at http://www.aboutads.info (or the European Interactive Digital Advertising Alliance’s opt-out page at http://www.youronlinechoices.eu if you are located in the European Union). Some of our publisher clients have their own opt-out mechanisms that are linked from their websites or their online-posted privacy policies. You should review the privacy policies of those companies for these opt-out links if you no longer wish to receive targeted advertising from a certain company, or multiple companies.

Please be advised that this type of opt-out is cookie-based, which means that if you block cookies, upgrade your browser or delete your cookies, you will need to opt-out again. Also, in order for your opt-out choice to be effective, you must ensure that your browser is set to accept third-party cookies. Some browsers block third-party cookies by default, and you may need to change your browser settings to accept third-party cookies before opting out. If you use a different device or browser, or erase cookies from your browser, you will need to renew your opt-out choice. Even if you opt-out, TaurusX may continue to collect data for other purposes and you still will receive advertising from TaurusX  Ad Service when you visit websites of a publisher client who uses our Platform – but such advertising will not be targeted to you.

(c) Additional Choices

You may opt-out from receiving promotional emails from us, such as emails to inform you about events and new services, by following the “unsubscribe” instructions in any promotional email you receive, or by contacting us at dpo@taurusx.com.

2.8 SUBSECTION FOR EEA USERS ONLY

(a) Legal basis for Processing EEA or UK Users’ Information

If you are a user located in the European Economic Area (hereinafter the “EEA”), as defined in GDPR, or United Kingdom our legal basis for collecting and using your user information shall be a subject to particular circumstances of collection and/or processing your information. The basis for collection, storage, or processing your personal data is your informed consent or where we have a legitimate interest in processing the personal data. Where we rely on consent to collect and/or process your user information, we obligate our clients to obtain such consent in compliance with applicable GDPR provision and applicable laws.

Generally, with respect to personal data collected through our services, we are acting as a data processor; with respect to personal data collected through our website, we are acting as an independent data controller. In specific collaborations, the designation of our role will be clearly defined according to the stipulations of the Data Processing Addendum (DPA).

If you have questions or need further information regarding the manner of use and legal basis for collecting and using your user information, please contact us. Please be advised that we will require reasonable proof that you are a subject to GDPR protection in order to process your inquiry in accordance with this subsection.

(b) Data Subject Rights of The Residents of The European Economic Area

If you are a resident of the EEA, you have certain data protection rights. TaurusX endeavors to take reasonable steps to allow you to correct, amend, delete, or limit the use of your personal information, thus to enforce all rights provided to you under the GDPR.

The GDPR gives certain rights to individuals in relation to their personal data. Accordingly, TaurusX are happy to offer transparency and access controls to help users take advantage of those rights.

You (as a ‘data subject’) may send official requests to us regarding your personal data via email to the following address: dpo@taurusx.com. At any time, you have the following rights:

Right to access – This right allows individuals to obtain confirmation as to whether personal data concerning them is being processed and provide access to such personal data. It also allows individuals to request details of the processing of their personal data including, without limitation, categories of recipients to whom the personal data have been or will be disclosed and purposes of processing.

Right to rectify – This right allows individuals to rectify any inaccurate personal data about them.

Right to restrict processing – This right allows individuals to block or suppress processing of personal data under certain circumstances.

Right to be forgotten – This right is also known as the “right to erasure”. It is an individual’s right to have personal data erased or to prevent processing in specific circumstances.

Right of data portability – This right allows individuals to move, copy or transfer personal data from one place to another in a secure manner without interrupting the integrity and usability of the information.

Right to object to processing – This right allows individuals to object to certain types of processing, including direct marketing, profiling, and providing for purposes of scientific or historical research and statistics.

(c) Right To Lodge a Complaint With A Supervisory Authority

You have the right to lodge a complaint with a supervisory authority.

(d) Legal Necessity

We process personal data in case of necessity to comply with applicable laws and regulations. For instance, for the mere purpose of identification, the jurisdiction of the information and where it comes from, we have to collect user IP address. Similarly, your mobile device identifier will likely be used (unless our technology allows otherwise), in order to identify a user who had withdrawn his/her personal data processing consent. Similarly, as soon as you withdraw your consent, we will have to provide our clients with your personal information to make sure that your consent has been withdrawn throughout the entire system.

(e) Legitimate Interest

In some cases, legitimate Interest allows us to process certain information without consent: for instance, to prevent fraudulent activity. Legitimate interest use will be determined by us on ad hoc basis for each particular platform or service. 2.9 SUBSECTION FOR UK USERS ONLY

After Brexit, the UK is no longer regulated domestically by the EU's General Data Protection Regulation (GDPR), which governs processing of personal data from individuals inside the EU. Instead, the UK now has its own version known as the UK-GDPR (United Kingdom General Data Protection Regulation). The new UK-GDPR took effect on January 31, 2020.

Under the UK-GDPR, individuals can exercise: the right to be informed; the right of access; the right to rectification; the right to erasure; the right to restrict processing; the right to data portability; the right to object to processing; the rights in relation to automated decision making and profiling

If you would like to exercise any of these rights (as a resident of UK), please contact us with a reasonable proof that you are subject to these rights.

Please note, as we already stated most information we deal with is anonymized when we receive and process it, therefore, we cannot identify you individually, you need to provide us with some additional information to enable us to identify the user information you are referring to, it may be technologically impossible to identify your information, although we will try to accurately fulfill your request. Please also read regarding our responsibility for the actions of our clients in Section I.

2.10 SUBSECTION FOR US USERS ONLY

(a) Data Protection Rights of The Residents of California and Virginia

TaurusX expresses its willingness to comply with any and all the principles and requirements of data processing under California Consumer Privacy Act (CCPA) and under Virginia Consumer Data Protection Act (VCDPA) effective January 1st, 2023.

(b) Storage and Sharing of User Information

We only store information in case of necessity. Please be aware that certain laws and regulations may subject us to store user information for a particular period: money laundering laws, financial reporting regulations, tax laws etc. Furthermore, we may have to comply with the decision of the court of appropriate jurisdiction and maintain information for the longer period.

We share user information that we collect as follows:

(c) We share information with our clients. It is done to help them identify, buy advertising, and target particular publishers. Clients may use this information in conjunction with other information they have independently collected to provide you targeted advertising materials. They also evaluate and analyze particular advertisement campaigns, inventory, etc.

(d) Change of Control. We may share user information in connection with mergers, acquisitions, events of change of control, including but not limited to sale or transfer of all or a part of our business or assets. In this case, your informed consent, if applicable, will be granted to a new entity in accordance with the event of a change of control.

(e) Compliance with laws and regulations. We may share user information with law enforcement, regulatory authorities, courts with competent jurisdictions, emergency services or other necessary third parties for legal, protection, security, and safety purposes, including but not limited to the purpose of compliance with laws or regulatory requirements and to responses to lawful requests including requests of governmental entities, enforcement of our own policies and agreements, protection of our clients, agents, employees, directors, officers and alike.

(f) Other service providers. SSP, DSP, and DMP services are based on specific platforms that actively communicate with other platforms, including but not limited to other SSP, DSP, and DMP platforms. Additionally, we use services of various third parties in order to analyze data, prevent fraud, host data, maintain, and support our client’s platforms, and for such other and further related services that are necessary to provide our services.

2.11 Security

To prevent unauthorized access and disclosure, to maintain data accuracy, and to ensure the appropriate use of your information, we utilize industry standard physical, technical, and administrative procedures to safeguard any personal information we collect. Please note that no transmission or storage of information, however, can ever be guaranteed to be completely secure, though we take all reasonable precautions to protect against security incidents.

2.12 Policy towards children

Our services are not directed to people under 18. If you become aware that your child has provided us with personal information without your consent, please contact us. We do not collect personal information from children under 18. If you are a minor, you may use our services only in conjunction with a parent or guardian.

3.1 Collecting Personally Identifiable Information

For purposes of this Privacy Policy, “Personally Identifiable Information” shall mean any information obtained through your use of the Website. This section does not refer to any information we store, collect, or process using our services.

The Personally Identifiable Information that you must submit in order to register as an Advertiser or Publisher, or to enter into an agreement with us, may include, without limitation, your name, title, company name, mailing/billing address, e-mail address, telephone number, Skype name, credit card information and/or bank account information. To the extent Personally Identifiable Information has been collected from you, you acknowledge that such collection is done on a voluntary basis to enable us to provide you efficient access to our materials and/or inventory, services, promotions, and our other products and/or services.

3.2 Collecting Non-Personally Identifiable Information

We automatically collect Non-Personally Identifiable Information when you access and use this Website. This Non-Personally Identifiable Information includes, without limitation, the type of browser that you use (e.g., Internet Explorer, Chrome, Safari), your IP address, the type of operating system that you use (e.g., Windows or Mac OS), and the domain name of your Internet service provider (e.g., Verizon, AT&T).

We use Non-Personally Identifiable Information to help diagnose problems with our server, to personalize your Internet experience, and to identify ways of making the Website better. We also may use this Non-Personally Identifiable Information in the aggregate to analyze Site usage, as well as to offer you products and services. This Non-Personally Identifiable Information is not linked to any Personally Identifiable Information.

3.3 IP address

An IP address is automatically assigned to your computer every time you establish a connection to the Internet. TaurusX advertisement materials and/or inventory uses your IP address to help diagnose problems with our server and to administer our website. When you open an account on TaurusX advertisement materials and/or inventory, your IP address will be associated with personally identifiable information.

3.4 Cookies

We use cookies on this site. We do not link the information we store in cookies to any personally identifiable information you submit while staying on our site. We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period. You can remove them by following directions provided in your Internet browser's "help" file.
